The HTC Golf, as it’s known by codename, has been rumored to be in the works for quite some time now, but today marks our first virtual encounter with the device. Thanks to a leaked press image acquired by PocketNow, we can finally get an idea of what HTC’s alleged entry-level slab may look like. Aside from being coated with a fresh version of Sense, the 3.5-inch Golf is also said to be packing an underwhelming 480 x 320 display, a single-core CPU, 512MB of RAM and 4GB of onboard storage (expandable via microSD). Additionally, word on the web has the Golf as being an eventual member of the outfit’s Wildfire family, though we’d hold off on giving it a different dub just yet. Either way, perhaps this one will be good enough to wave goodbye to that ChaCha of yours.

Updating your Facebook status from your work computer ? even if it violates your company’s policy ? isn’t a federal crime, according to a ruling by a San Francisco federal appeals court.?

Sure it sounds extreme that such a question was even pondered by a federal court. ?But Facebooking and similar computer-based goldbricking could’ve been considered a violation of the the Computer Fraud and Abuse Act (CFAA) if the San Francisco’s Ninth Circuit didn’t dismiss “charges that would have criminalized any employee’s use of a company’s computers in violation of corporate policy,” notes the Electronic Frontier Foundation:

In (U.S. v. Nosal), the government prosecuted an ex-employee of an executive recruiting firm on the theory that he induced current company employees to use their legitimate credentials to access a proprietary database and provide him with information in violation of corporate computer-use policy. The government claimed that the violation of policy constituted a violation of the CFAA, a law with criminal penalties.

While the case isn’t specifically focused on Facebook, the ruling is another example of how the government is increasingly sucked into the conflict between how we earn a living and how we use the world’s largest social network.?Earlier this week, Maryland became the first state to pass a bill prohibiting employers from demanding employee user names and passwords to Facebook and other social networks. In March, two U.S. senators asked federal agencies to look into whether employers and colleges that are asking for access to individual Facebook profiles are breaking the law.??

In?U.S. v. Nosal, accessing Facebook through work computers ? if against company policy ? could’ve been deemed a federal crime as well.?

In its role as a digital rights advocate, EFF filed an amicus brief ? an opinion volunteered by a party not involved in a legal case. In it, EFF argued that “turning mere violations of company policies into computer crimes could potentially create a massive expansion of the law ? making millions of law-abiding workers criminals for innocent activities like sending a personal email or checking sports scores from a work computer, and leaving them vulnerable to prosecution at the government’s whim.”?

In its full opinion, the court agreed:?

Many employers have adopted policies prohibiting the use of work computers for nonbusiness purposes. Does an employee who violates such a policy commit a federal crime? How about someone who violates the terms of service of a social networking website? This depends on how broadly we read the Computer Fraud and Abuse Act.

The court’s findings overturn last year’s ruling by a previous court which found that employees who violate their employer’s computer policy could be accused of breaking the CFAA. The new opinion points out that broad interpretation of the CFAA could criminialize typical human behavior:?

Minds have wandered since the beginning of time and the computer gives employees new ways to procrastinate, by gchatting with friends, playing games, shopping or watching sports highlights. Such activities are routinely prohibited by many computer-use policies, although employees are seldom disciplined for occasional use of work computers for personal purposes. Nevertheless, under the broad interpretation of the CFAA, such minor dalliances would become federal crimes. While it?s unlikely that you?ll be prosecuted for watching Reason.TV on your work computer, you could be. Employers wanting to rid themselves of troublesome employees without following proper procedures could threaten to report them to the FBI unless they quit. Ubiquitous, seldom-prosecuted crimes invite arbitrary and discriminatory enforcement.

“EFF has been fighting these aggressive government hacking arguments for years,” EFF Staff Attorney Hanni Fakhoury said in a statement. “We’re happy to see the court recognize that the government overreached here, and it issued a thoughtful decision that protects the rights of users.”

Pope calls for peace, justice in Mexico

Pope Benedict at a huge outdoor Mass urged Mexicans to boldly promote peace and justice in their country, where a murderous drug war has led to tens of thousands of deaths.

On his last day in Mexico, the pope said Mass on Sunday for a vibrant crowd that organizers estimated at 300,000 people at a sprawling park on the outskirts of Leon in central Mexico, the biggest turnout for his Latin American trip.

The 84-year-old pope, wearing purple and white vestments, sprinkled the sermon he read from a massive white altar platform on a hillside with words such as conversion and reconciliation.

Many in the crowd covered their heads with hats, sheet and umbrellas against the blazing sunshine as Benedict prayed that Mexicans would be given the strength “to boldly promote peace, harmony, justice and solidarity.”

Long lines of people, many praying, singing and carrying pictures of the leader of the world’s 1.2 billion Roman Catholics and Our Lady of Guadalupe, Mexico’s patron, flooded into the Mass site for hours.

Some camped out for more than a day to get a good spot at the event, the highlight of Benedict’s three days in the world’s second-most populous Roman Catholic country.

As the pope toured the crowd in a popemobile, he donned a black-and-white sombrero, to the delight of the crowd.

The archbishop of Leon, Jose Martin Rabago, set the tone by spelling out the sufferings of a country where clashes between drug cartels and the state have claimed more than 50,000 lives over the past five years.

“In the past few years we have been living through events of violence and death that have generated a painful sensation of fear, helplessness and grief,” Rabago told the pope and the crowd in his welcome address.

The archbishop condemned what he called the “perverse roots” of Mexico’s problems, listing them as poverty, lack of opportunity, impunity, injustice and the belief of some that life’s aim was to accumulate possessions and power.

“The overwhelming majority of our people,” the archbishop told the pope, “does not want to walk along the path of death and destruction. They yearn to live in peace…”

Those words brought comfort to Santa Gurrola, a 38-year-old doctor from Zamora in Michoacan state in western Mexico who spent the night in the park.

“We are all praying so that our beloved Mexico stops being the place of so many murders,” she said. “In my state drug traffickers control everything. We need a blessing from the pope,” she said.

On his way to the venue, the pope flew by helicopter over the giant hilltop monument with the statue of Christ the King, a symbol of the often stormy religious heritage of Mexico, which was officially anti-clerical for years after a 1910 revolution.

“We need the pope to motivate us with encouraging words so some good will come to us after everything that is happening,” said Aarom Gonzalez, an engineering student from nearby Guanajuato. “There is violence on our streets and in our families.”

Benedict, who leaves for Cuba on Monday, addressed the problem of drug trafficking and the violence it sprouts in comments to reporters aboard the plane that brought him to Mexico from Rome on Friday.

He promised to “unmask the evil” of the spiraling drug war and the “idolatry of money which enslaves man”.

On Saturday night, the pope comforted a group of eight victims of the drug war. Alongside President Felipe Calderon, Benedict met relatives of a soldier and a policeman killed in combat with cartels, a man who survived a kidnapping, and the sister of a student shot by stray bullets during a street fight.

Calderon, from the conservative National Action Party, or PAN, which receives strong support from Catholics, has been criticized by the opposition for the timing of the pope’s visit just 14 weeks before the next presidential election.

The president has staked his reputation on beating down the cartels. But the government’s inability to stem the gangland violence has eroded support PAN, which faces an uphill struggle to retain the presidency in elections in July.

Calderon cannot run for re-election and the PAN’s candidate, Josefina Vazquez Mota, trails the presidential front-runner, Enrique Pena Nieto of the opposition Institutional Revolutionary Party (PRI), by double digits in most opinion polls.

While there no guarantees that polyamorous families, monogamous nuclear families, step families, extended families, or any other kind of family will create stable and nurturing environments where children can develop in an atmosphere of love and security, there are reasons to think that polyamory may be at least as good as the other options for raising healthy children. Maybe it’s time for public policies that support polyamorous families!
